Happy New Year. Watch this blog for developments in U.S. environmental law. Its been several years since I was last able to post to this blog. Years that have seen the solidification of W's anti-regulatory agenda, a major rightward movement of the Supreme Court, but also Massachusetts v. EPA (which not only puts the Agency on notice that they may regulate greenhouse gasses, but also modestly expands the power of the courts to push agencies to take action), Duke Energy (which resuscitated the New Source Review, against W's best efforts to kill it), and United States v. Atlantic Research (which finally allows property owners to voluntarily clean up Superfund sites. And, of course, the world and the country has finally taken notice of global warming, and is primed to change. This blog will track where we go from here.
